Terms of Service

Governed by the laws of the Commonwealth of Virginia and applicable United States federal law, including FTC regulations and the Virginia Consumer Protection Act (Va. Code § 59.1-196 et seq.).

2. What These Terms Govern

These Terms apply to your use of elrakus.com and to every purchase made through it. Browsing the site or placing an order means accepting them.

They may be revised as the business changes. Whichever version is published when you place an order is the version governing that order; a later revision never reaches back to alter a completed transaction.

You must be 18 or over, or the age of majority in your state, to buy from Elrak.

3. When the Contract Forms

  1. You add items to your cart.
  2. You enter your name and a complete United States delivery address.
  3. You select a payment method.
  4. You review the summary: items, quantities, price, tax, and any delivery charge.
  5. You click "Place order", which is your offer to buy on these Terms.
  6. We send an order confirmation email. That confirmation is our acceptance, and the contract forms at that moment.

The contract language is English. Before confirmation there is no contract, and we may decline an order where stock has run out, where a price was plainly wrong, or where a transaction looks fraudulent. In every such case any money taken is returned in full.

4. Prices and Tax

Prices appear in United States Dollars. Sales tax is calculated at checkout from your delivery address under applicable state and local rules, and is shown before you confirm.

Prices can change at any time, never retroactively for a confirmed order. If an item is listed at an obviously incorrect price through a technical or human error, we contact you before shipping and you choose between paying the corrected price or cancelling for a full refund.

5. Payment

Elrak accepts:

  • Visa, Mastercard, American Express, and Discover, via Shopify Payments
  • PayPal
  • Apple Pay
  • Google Pay
  • Shop Pay

Payments are processed by Shopify Payments and the card networks, all operating under the Payment Card Industry Data Security Standard (PCI DSS). Full card numbers never reach our systems. We see only that the payment succeeded, plus the card type and last four digits for reconciliation.

6. Stock

We keep the catalogue as close to real stock as we can, but a listing can outrun the shelf. Where an item proves unavailable after your order, we email you, cancel that line, and refund it in full. We never substitute a different colour or model without asking first.

7. Product Descriptions

Capacities, dimensions, weights, and materials are published as accurately as we can establish them, drawing on manufacturer data. Two points deserve your attention before buying:

  • Colour. Leather, canvas, and coated nylon all photograph differently from how they look in daylight, and every screen renders them differently again. Expect a reasonable variation between image and item.
  • Airline carry-on limits. Where we describe a bag as cabin-sized, that reflects the dimensions commonly accepted by major US carriers at the time of writing. Airlines change their allowances without notice and enforce them inconsistently. Always check your specific airline's current limits before you fly. We cannot be responsible for a gate agent's decision.

Stated capacities are the manufacturer's. Loading a bag well beyond them stresses seams, zips, and strap anchors, and damage caused that way is not a defect.

8. Delivery and Returns

Delivery terms sit in our Shipping Policy and your 90-day right to return sits in our Returns & Refunds Policy. Both form part of these Terms.

9. Our Content

The text, photography, graphics, logos, icons, layout, and code making up elrakus.com belong to Elrak or its licensors and are protected by United States copyright and trademark law. View and print pages for private use freely. Copying, republishing, scraping, or adapting any part commercially requires our written permission.

10. Acceptable Use

You agree not to:

  • use the site unlawfully or fraudulently;
  • attempt to access systems, accounts, or data you have no right to;
  • introduce viruses or code designed to disrupt the site;
  • harvest content or data by automated means without consent;
  • resell any part of the site, or impersonate Elrak or another customer.

11. Limitation of Liability

Elrak is not liable for indirect, incidental, special, or consequential loss arising from use of the site or inability to use it, save where caused by our own willful misconduct or gross negligence.

Our total liability on any order is limited to what you paid for that order. This does not remove any right you hold under mandatory consumer protection law, including implied warranties under Virginia law, and does not limit liability for personal injury caused by a defective product.

12. Events Outside Our Control

Neither party breaches these Terms through a delay caused by events beyond reasonable control, including severe weather, natural disaster, industrial action, carrier failure, power or network outage, or acts of government.

13. Disputes

Come to us first, at info@elrakus.com. Almost everything is settled there within 2 business days, and we would rather fix a problem than defend one.

If that does not resolve it, you may approach the Virginia Office of the Attorney General, Consumer Protection Section (oag.state.va.us, 1-800-552-9963), the Federal Trade Commission at reportfraud.ftc.gov, or your own state's consumer protection office.

14. Governing Law and Venue

These Terms are governed by the laws of the Commonwealth of Virginia, without regard to conflict of law rules. Proceedings arising from them belong in the state or federal courts sitting in Virginia, except where consumer protection law entitles you to bring a claim in the courts of your own state of residence.

15. General

If any provision is found unenforceable, the rest stands. Not enforcing a provision once does not waive it. These Terms, together with the Shipping Policy, the Returns & Refunds Policy, the Privacy Policy, and your order confirmation, form the entire agreement between us.
